Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) are a legal agreement between you and Track Speed Development Pty Ltd (ABN 77 647 817 516), trading as TrackStat (“TrackStat”, “we”, “us”), governing your use of trackstat.app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 18 years old to create an account. You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity under your account. Notify us promptly at info@trackstat.app if you suspect unauthorised use.

3. The Service and plans

TrackStat provides tools for analysing athletic performance, including video analysis, calculators, GPS and competition analysis, and squad management. We offer different subscription plans with different features and limits, described on our pricing page. We may add, change or remove features over time.

You keep all rights to the data and content you put into the Service — athletes, videos, results and analyses (“Your Content”). You grant us a limited licence to host, process and display Your Content solely to operate and provide the Service to you. We handle personal information as described in our Privacy Policy.

We may suspend or terminate accounts that breach these Terms or put the Service or others at risk.

8. Intellectual property

The Service, including its software, design and content we provide, is owned by TrackStat and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership to you. “TrackStat” and our logo are our marks and may not be used without permission.

9. Cancellation and deletion

You may cancel your subscription at any time; access continues until the end of your current billing period. You may request deletion of your account and all associated data by using the in-app option (where available) or emailing info@trackstat.app. On deletion we remove your data as described in the Privacy Policy, within 30 days, other than limited records we must keep by law. We may terminate or suspend your account for breach of these Terms, with notice where practical.

10. Disclaimers

The Service provides analysis tools to support coaching decisions; it does not provide medical, health or professional advice, and outputs may contain errors or rely on data you enter. You are responsible for how you interpret and use the results. The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Nothing in these Terms excludes rights you have under consumer law, including the Australian Consumer Law, that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, TrackStat will not be liable for indirect, incidental, special or consequential losses, or for loss of data or profits, arising from your use of the Service. Where our liability cannot be excluded but can be limited, and to the extent permitted by law, our total liability to you for any claim is limited to the amount you paid us for the Service in the twelve months before the claim.

12. Changes to the Service or terms

We may update these Terms or the Service from time to time. When we make material changes to the Terms we will update the effective date and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place, without affecting any mandatory consumer-law rights you have where you live.
